1. the parties involved
These Terms and Conditions of Use govern the use of services offered by poolrobotshop.com. The following terms, used in these conditions and on individual policy pages, are defined as follows:
- Platform: the website poolrobotshop.com.
- Services: all services offered by the owner, purchasable or purchased by customers.
- Products / Items: all products offered by the owner, purchasable or purchased by customers.
- Site / Website: poolrobotshop.com, including any other site used by the owner for selling their services.
- Customer: any private consumer and/or company/VAT number that has purchased even a single product/service provided by the owner.
- User: anyone browsing the site.
- Owner / Company / PoolRobotShop: the entity selling or providing the product/service to the user: FS Services Group S.R.L. based in Brehuiesti, Romania, VAT number: RO48857705, EUID: ROONRC.J7/632/2023.
- The parties: the parties to the contract, understood as the customer and the owner together.
- Order: explicit submission with payment made where the user specifies acceptance of these sales conditions, thereby accepting the owner's proposal.
- Sales conditions: terms and conditions (poolrobotshop.com/pages/terms-and-conditions).
- Clauses: all individual points, paragraphs, and conditions present in the relevant documents.
2. acceptance of sales conditions
To purchase and/or use any service and product provided and/or sold by the owner, users must accept these conditions by clicking the “I have read and accept the terms and conditions of sale” button during the purchase process.
By doing so, the user/customer expressly declares to have carefully read all the clauses/conditions and to accept all the clauses/conditions set forth on this page.
If the user does not accept, even partially, the conditions set forth on this page and in the individual policies, they are not authorized to use or purchase the products/services offered by the owner.
Any action and/or dispute arising from the unavailability or unwillingness of the customer to comply with the conditions set forth, subsequent to the purchase (with payment already made) of services/products offered by the owner, will be considered invalid and will not be taken into consideration. Consequently, the same sales conditions previously viewed, read, and explicitly accepted by the customer will apply.
3. general conditions
3.1 Except in cases where there is explicit reference to the Consumer Code and the consumer, these Sales Conditions apply equally to private individuals, companies, and VAT-registered entities not classifiable as private consumers.
3.2 The publication of products on the site constitutes an invitation to users to submit purchase proposals to the owner. Each purchase order correctly sent by the customer to the owner constitutes a contractual proposal.
3.3 The submission of each order constitutes the explicit acceptance of these sales conditions by the user/customer. The order will be considered correctly submitted only after the payment of the amount due for the chosen product, according to the methods provided by these sales conditions.
4. purchase and payment methods
The services/products provided by the owner will be available for purchase through specific forms to be filled out during the purchase process made available by the owner. The correct receipt of the order is confirmed by the owner via an email response sent to the email address provided by the customer.
This confirmation message will include the date, time of the order, and order number (to be used in any further communication and assistance requests).
The message will reiterate all the data entered by the customer, who agrees to verify its accuracy and promptly report any corrections, according to the methods described in this document. Payment for the service/product can be made either in a single payment or in two separate payments (where explicitly allowed and provided), in which the customer is obligated to make both transactions to complete the purchase of the service/product.
The available payment methods are: credit card, bank transfer, Paypal, cash on delivery (Only Available for Romania Market)
5. intellectual property
The client and all other parties have no right to claim as their own: the structure, layout, source code, content, plugins, idea, project, brand, texts, graphic appearance, concepts, illustrations, images, and any other elements pertaining to the PoolRobotShop website. All these elements are to be considered exclusively the property of the Owner and are protected by copyright.
Furthermore, all content belonging to and part of the PoolRobotShop brand is protected according to various intellectual property rights laws. This includes, but is not limited to, product images, descriptions, promotional videos, and any other multimedia material. Any unauthorized use by the client or any third party of the aforementioned content will be prosecuted in accordance with the applicable legal consequences.
The content displayed on this site is the property of the respective brands, Zodiac and Polaris, which are part of the Fluidra group. PoolRobotShop does not own rights to these contents and uses them exclusively with prior authorization as an authorized retailer. The same conditions apply to other brands present or to be presented on the site, for which PoolRobotShop has obtained explicit authorization for resale, thus using the brands' contents in compliance with applicable regulations.
Other retailers authorized to sell the same brands featured on the PoolRobotShop site have no right to use the media content owned by PoolRobotShop without explicit authorization. Any reproduction, distribution, modification, or use of such content without the written consent of the Owner or the brand owners will be considered a violation of intellectual property rights and will be subject to legal penalties.
The Owner reserves the right to take all necessary legal actions to protect their rights and interests.
6. prices and fees
All prices for the services/products offered by the owner are expressed in euros or in local currency where applicable and include value-added tax (VAT) where applicable.
The owner reserves the right to modify the prices of services/products at any time and without any prior notice to the user.
However, the price charged to the customer will always be the one indicated on the website at the time the order is placed. Any price changes (either increases or decreases) after the order is submitted will not apply to that order.
7. personal area
While browsing and ordering products/services, the customer has the option to create a “customer account” and use the internal platform on the website to check: previous orders, order dates, purchased products/services, their information (such as shipping addresses, billing addresses, contact information), etc. The creation of an account is subject to these terms and conditions, and customer information will be used and stored according to the privacy policy available on the appropriate page of the website.
The customer can modify or delete their data at any time. They are also required to keep account data private and not to disclose it to third parties. The customer must report any unauthorized use by third parties to the owner. Until such communication is reported to the owner, any access and any related action or use of the services associated with the customer account will be attributed to the customer themselves.
8. user obligations
When creating their profile and filling out the form on the site, the user agrees to enter their personal data correctly and truthfully, without uploading any illicit content. The use of third-party identities, fake identities, and temporary emails is prohibited.
The user is obligated to pay the amount due for the product to which the order refers, according to the methods indicated in these sales conditions. Where payment is in installments, the user is required to complete the payment of the full amount in installments within the time limit specified by the owner at the time of purchase.
The user agrees to indemnify any damage, cost, expense (including legal fees) caused to or incurred by the owner, directly or indirectly, from the user’s violation of the obligations set forth in paragraphs 10, 12, and any other obligation contained in these sales conditions.
9. product return policy
9.1 Conditions for exercising the right of withdrawal
The customer has the right to return products purchased on poolrobotshop.com without any penalty, additional cost, or obligation to provide reasons, within thirty (30) calendar days from the day the customer receives the products. All returns are free of charge; the owner will cover the return costs.
The customer is responsible for complying with all listed conditions and proceeding according to point 9.2 (How to make a return).
Upon receipt of the products by the owner, the sales contract will be considered null and void, and all related obligations, rights, or claims will expire, provided that if the returned products are damaged, the owner will have the right to offset such damage with the payment already made by the customer. Additionally, pursuant to Article 59 of the Consumer Code, the customer cannot exercise the right of withdrawal in the following cases:
- Absence of integral parts of the product (integral parts, accessories, manuals, etc.).
- Absence of original packaging, external and internal. (Boxes, films, manuals)
- Damage to the product due to improper or non-compliant use as per the provided instructions.
- Damage to the product during transport due to unsuitable packaging used for the return.
- Differences from the initial condition of the product, such as evident wear and tear or environmental influences that prevent resale in the original condition.
- Supply of goods made to measure or clearly personalized.

- Return of dirty or wet items; all items must be returned in identical hygienic and aesthetic conditions with the respective seals and packaging provided.
Any unauthorized use by the customer will be prosecuted according to the applicable legal consequences. The customer must compensate for any damage caused during transport if the original packaging is not used.
9.2 How to make a return
The customer must contact customer service via email or WhatsApp at the general contact number or by sending the form available on the contact page. After receiving confirmation of the right of withdrawal, the customer will receive a prepaid and prefilled return label from the owner. The customer will not incur any additional return shipping costs and will have a maximum of 20 days from receipt of the label to ship the package.
During this period, the use of the items by the customer is strictly prohibited. Any abuse will result in the total loss of the right of withdrawal. In case of non-delivery of the returned package, the customer must provide proof of delivery, i.e., the receipt bearing the signature of the recipient. Without such proof, the owner will not grant the refund.
Once compliance with the conditions is confirmed, the owner will send a confirmation email of the return acceptance and initiate the refund process, which will be completed within fourteen (14) days. The refund will always be made exclusively to the original payment method used by the customer.
If the above conditions are not met, the customer will not be entitled to a refund and may only request the return of the products at their own risk and expense. If the customer does not request the return of the products within sixty (60) days of the relevant communication, the owner will have the right to retain and/or dispose of them along with the amount received for the transaction.
10. shipping policy
The Owner offers free shipping for orders with a total value of at least €500.00 in all European Union countries. For purchases below this threshold, shipping rates will be calculated based on the customer's country and delivery location. All shipments are made via express courier, with tracking service and insurance covering any damages or losses up to the full value of the order.
Confirmed orders are processed and shipped within 48/72 hours, barring unforeseen circumstances. This timeframe is indicative and does not constitute a legally binding obligation. In case of delays, the customer will be promptly informed. Delivery times vary depending on the courier service and destination: on average, 5/7 days for most EU countries and 7/10 days for more remote areas of the same countries, such as islands and remote areas.
Given that the Owner's main shipping facility is located in Romania and that we have various warehouses across Europe, delivery times may differ based on the product's location at the time of purchase. After shipping, the customer will receive an email with a tracking link, which will be activated once the goods are picked up. In the absence of the recipient at the provided address, the courier will leave a missed delivery notice and will attempt delivery again on the next working day.
After a second unsuccessful attempt, the order will be held at the nearest branch. The customer can either collect the package from the holding address or arrange a new delivery by contacting the branch or our customer service. Deliveries do not occur on holidays or non-working days.
The Owner assumes full responsibility for any damage, theft, or loss of packages during transport. In such cases, the customer will be refunded the full amount, effectively canceling the sales contract. Alternatively, with the customer's agreement, a new package containing the same ordered items will be sent. The customer has the freedom to choose between these two options.
Any delays or non-deliveries due to force majeure or unforeseeable circumstances by the courier are not the responsibility of the Owner. Please note that orders placed during peak periods, such as holidays, may experience delays.
11. legal warranty
All products sold by PoolRobotShop (authorized dealer) are covered by the manufacturer's warranty for defects in conformity, as provided by applicable regulations. The warranty period varies depending on the model purchased and the final consumer. For private consumers, the standard warranty period is indicated on the product page at the time of purchase, in the "Warranty" section, and can range from 24 to 48 months depending on the product.
The warranty for legal entities, companies, or VAT holders not classified as private consumers is limited to a period of 12 months for any product, in accordance with Directive 1999/44/EC of the European Parliament and of the Council on certain aspects of the sale of consumer goods and associated guarantees.
To exercise warranty rights, the Customer must retain the invoice or order confirmation sent to the email address provided at the time of purchase.
The manufacturer's warranty is provided according to the terms specified in the documentation included with the product. If, after an inspection by an Authorized Service Center, the defect is found not to be covered by the manufacturer's warranty, the Customer will be charged for the verification and repair costs required by the Authorized Service, as well as transportation costs.
The legal warranty applies to products that present a defect in conformity, provided they have been used correctly and in accordance with the instructions in the attached technical documentation.
In the event of a defect in conformity, PoolRobotShop will restore the product's conformity without any charge to the Customer, either by repair or replacement. Alternatively, the Customer may request an appropriate price reduction or the termination of the contract.
If, following an inspection by an Authorized Service Center, no defect in conformity is found, the Customer will be charged for the verification and repair costs required by the Authorized Service, as well as transportation costs.
In cases where it is not possible, or excessively costly, to restore or replace the non-conforming product under warranty, PoolRobotShop may, with the Customer's consent, provide a different product with equivalent characteristics and value. The Consumer retains the right to request an appropriate price reduction or the termination of the contract.
The Seller disclaims any liability for damages resulting from delays in repairing or replacing warranty products when such delays are not attributable to PoolRobotShop.
When the application of the warranty requires the return of the product, the item must be returned by the Customer in its original packaging, complete with all its parts (including packaging, documentation, and accessories: manuals, cables, etc.).
During the warranty period, upon the Customer's request, PoolRobotShop commits to sending a temporary replacement product free of charge. However, the replacement product may not be identical to the purchased product and may not offer the same performance. PoolRobotShop disclaims any liability in this regard.
If the warranty period has expired or the warranty is not applicable, the Customer will be required to pay PoolRobotShop for the rental and any applicable costs for the use of the temporary replacement product. These costs will be communicated to the Customer prior to the shipment of the temporary product.
PoolRobotShop excludes any liability for lost profits, damages, or delays due to the malfunction of the temporary replacement product, as well as for manufacturing defects of the originally purchased product.
11.2 Warranty Exclusions
The effectiveness of this warranty is conditioned upon proper use and maintenance, as well as compliance with the usage and maintenance instructions provided by the manufacturer in the packaging and by the owner on the product pages of the individual items.
The owner disclaims any responsibility if the provided instructions are in a language different from the country of destination of the product or the customer’s country. Therefore, the customer fully accepts and assumes the responsibility of requesting instructions in their own language from the product manufacturer or translating the provided instructions if deemed necessary.
Damage or malfunction of products used improperly, whether intentionally or unintentionally, is not covered by the warranty.
This includes improper, inappropriate, unsuitable, or non-compliant use, whether voluntary or involuntary, with the specifications, usage methods, and regular maintenance (instructions) explicitly stated by the manufacturer and the owner on the post-purchase page sent via email and/or viewed after purchase.
By accepting the terms and conditions at the time of purchase, the customer is fully responsible for any voluntary and/or involuntary damage caused to the product due to lack of knowledge and awareness of the product itself.
Similarly, by accepting these terms, the customer expressly declares to have reviewed, after purchase, the specifications, usage methods, regular maintenance procedures, and consequently all the instructions for each of the purchased products, and therefore to have fully understood every detail.
The warranty also does not cover:
- Parts subject to wear in the short and medium term: such as brushes, filters, bags, power cables subject to aggressive environmental influences, housings, bumpers, disposable parts.
- Fragile parts in case of even minimal breakage: such as glass, sensitive plastics.
- Minor deviations of the product from what is due that do not affect the value and effectiveness of use.
- Damage caused by aggressive environmental influences, chemicals, or detergents of any kind.
- Damage due to use for a purpose other than that for which it was designed. (The customer undertakes not to use the product before reviewing the instructions for use available on the individual product pages. Note: if the instruction manual provided by the manufacturer or the owner is in English or a language not understood by the customer, the customer is obliged to use readily available translation tools to understand the mentioned documents.)
- The owner is not responsible for any misunderstandings or lack of understanding of the instructions by the customer, even if minimal.
- Damage caused by force majeure or natural disasters.
- Damage and malfunctions not reported by the customer.
- Opening/repair of the product by a person/company other than the dealer itself (unless expressly authorized by the owner).
11.3 Liability and Additional Costs
If a defect is found not to be covered by this warranty, the shipping costs of the product are borne by the customer. If, after being informed of the lack of warranty coverage and the costs expected for a potential repair, the customer wishes to proceed with the repair of the device, they must bear the costs of spare parts and labor for the repair.
If the product presents secondary malfunctions or defects not indicated by the customer, the latter will be held responsible for each undisclosed malfunction or defect. Any costs due to repair/replacement interventions for undisclosed secondary damages will be borne by the customer.
12. exclusion of liability
The Company is not liable to the Customer or any Third Parties for physical, moral, or any other type of damages resulting from Products purchased directly from the Site, in the event of:
12.1 Improper and/or non-compliant use of the Product by the Customer, contrary to the provisions of the technical documentation attached or present on the individual product pages. The Customer agrees not to use the product before reviewing the instructions for use.
Note: if the instruction manual provided by the manufacturer or the owner is in English, the customer is obliged to use readily available translation tools to understand the mentioned documents. The owner is not responsible for any misunderstandings or lack of understanding of the instructions by the customer, even if minimal.
12.2 Use of the Product for purposes other than those for which it was designed.
12.3 Manipulation of the Product or parts thereof by the Customer.
12.4 Negligence or failure to maintain the Product by the Customer.
12.5 Maintenance entrusted by the Customer to third parties unknown and unauthorized by the Owner.
12.6 Force majeure.
The Owner is not liable for written statements and/or information provided to the customer that are not accurate or differ from what is stated in the instruction manual.
The customer is obliged to follow the usage prescriptions provided by the official manufacturer meticulously.
The Owner also offers assistance and repair services for Products purchased on the Site or for Products provided by the User, provided they are of the same type as those sold on the Site.
For this purpose, it should be noted that the technicians performing these maintenance operations are authorized by the manufacturer Zodiac. Regarding other brands for which customers may request repairs, such as Dolphin, Maytronics, BWT, Hayward, Aquatron, and Aquabot, our technicians are industry experts but have no working or other relationship with the brand owners of the aforementioned products they repair. Consequently, the Company and its technicians are not liable for any damages of any kind resulting from malfunction or improper or non-compliant use of the Products they have repaired.
13. repair & assistance services
The Owner offers repair and assistance services for items purchased through the site as well as for external items out of the manufacturer's warranty.
The repair process is detailed in each sales section and includes the following phases: collection (sending the item to the Owner) (performed by the customer at no cost or by the Owner for a fee depending on the country of collection), free diagnosis and estimate, customer confirmation, repair, testing, and return delivery.
For this purpose, it should be noted that the technicians performing these maintenance operations are authorized by the manufacturer Zodiac. Regarding other brands for which customers may request repairs, such as Dolphin, Maytronics, BWT, Hayward, Aquatron, and Aquabot, our technicians are industry experts but have no working or other relationship with the brand owners of the aforementioned products they repair.
Repairs are carried out exclusively at the Owner's operational headquarters in Romania. The estimated time for repair ranges from 2 to 3 working days from the provision of the estimate and acceptance; this timeframe may vary depending on various factors such as receipt of the machinery, diagnostic times, availability of spare parts, repair times, and delivery times.
This period is only an estimate and does not constitute a legally binding obligation.
If the repair time exceeds the estimates, the Owner will promptly inform the customer. If the customer accepts the estimate, the Owner will proceed with the repair, testing, and return of the item. If the customer rejects the estimate, they will only be required to cover the costs for collection (sending the item to the Owner) and return delivery, depending on the country of collection (the rates will be shown on the product page). Alternatively, if the customer prefers not to proceed with the estimate, they can instruct the Owner to dispose of the items in question at no additional cost.
The warranty offered by the Owner for the repair is limited exclusively to the replaced components and follows the terms of the main manufacturer's warranty. Wear components and parts are excluded. In the event that the customer does not accept the estimate and does not arrange for the collection of the product within 30 days from the date of the estimate communication, or does not respond within the same period, the Owner will send a disposal notice.
If the customer does not respond within 14 days of the notice, the product will be considered abandoned, and the Owner will proceed with the destruction or disposal of the product without the possibility for the customer to make any claims for damages, expense reimbursements, or other requests of any kind. The customer is required to pack the item carefully following the instructions provided by the Owner. The Owner is not responsible for damage due to inadequate packaging performed by the customer.
14. language and applicable laws
These terms and conditions are drafted in various languages depending on the target markets. If the terms and conditions are not available in the customer's country language, the customer is required to translate them or refer to the English version. The relationships between the consultant and the user/customer are governed exclusively by Romanian law.
15. communications and complaints
All communications and/or any complaints from the User to the Company must be sent to the following email address: office@poolrobotshop.com.

16. last modification
The last modification of these Terms and Conditions was made on 12.07.2024. Any changes to these Terms and Conditions will become effective and binding for the User upon publication on the Site and will apply to sales made from that date onwards. Changes to these Terms and Conditions, resulting from needs and/or regulatory updates, will be published on the Site to inform the User.
